1. Agreement to these terms
These Terms of Service ("Terms") govern your access to and use of avatar-lab.net and the Avatar Lab platform (together, the "Service"), operated by Avatar Lab ("Avatar Lab," "we," "us"). By requesting a demo, creating an account, or otherwise using the Service, you agree to these Terms on behalf of yourself and, where applicable, your organisation.
2. What the Service does
Avatar Lab is a production system for AI KOLs and digital humans. It lets a customer build a character once from identity references and traits, turn creative briefs into structured shot sequences, route renders through a review-and-approval step, and generate content that is checked against the original identity — with production history, cost tracking, and organisational isolation of records. A human always reviews and approves content before it renders; the Service is not a fully autonomous system.
3. Accounts and access
- You're responsible for the accuracy of the information you provide and for activity that happens under your account or your organisation's workspace.
- Access to the platform is provided under a separate order or agreement between Avatar Lab and the customer; these Terms apply alongside that agreement.
- You must keep login credentials confidential and notify us promptly of any unauthorised use.
4. Likeness, identity, and rights you upload
If you or your organisation upload photos, video, voice, or other material to build or maintain an AI KOL, you represent and warrant that you have all necessary rights, consents, and permissions to use that material for this purpose — including likeness, publicity, and any applicable talent or model releases. Avatar Lab does not verify these rights on your behalf. Responsibility for likeness and usage-rights clearance rests with the customer and, where relevant, their legal counsel.
5. Acceptable use
You agree not to use the Service to:
- Create or distribute content that infringes someone else's rights, including likeness or intellectual property rights;
- Create deceptive or fraudulent content, or content intended to impersonate a real person without authorisation;
- Upload unlawful, defamatory, or harmful material;
- Attempt to circumvent the review-and-approval workflow, or interfere with the platform's security or normal operation.
6. Content ownership
As between you and Avatar Lab, you retain ownership of the identity references, briefs, and other material you upload, and of the content generated for your organisation through the Service, subject to the rights you've granted us to operate the Service and to any separate agreement in place. Avatar Lab does not claim ownership of your generated content.
7. Fees
Fees, if applicable, are set out in the order form or agreement between you and Avatar Lab and are not published on this site.
8. Disclaimers
The Service is provided "as is." While Avatar Lab is built to check renders against a locked identity and route content through human review before it's finalised, we don't guarantee that every output will be free of error, and we don't guarantee any specific business, engagement, or performance outcome from using generated content.
9. Limitation of liability
To the maximum extent permitted by law, Avatar Lab and its officers, employees, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Service. Our total liability for any claim arising from these Terms or the Service will not exceed the amount you paid us for the Service in the twelve months before the claim arose. Nothing in these Terms limits liability that cannot be limited under applicable law.
10. Indemnification
You agree to indemnify and hold Avatar Lab harmless from claims, damages, and expenses arising from your breach of these Terms, your violation of any law, or your lack of rights to any likeness or material you upload to the Service.
11. Termination
We may suspend or terminate access to the Service for a violation of these Terms or of an underlying agreement. You may stop using the Service at any time, subject to the terms of any separate agreement in place.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above.
13. Governing law
These Terms are governed by the laws of Hong Kong SAR, without regard to conflict of law principles, and any dispute arising from them will be subject to the exclusive jurisdiction of the courts of Hong Kong.
